Creavies User Terms

1. Introduction
Welcome to Creavies! These User Terms (the “Agreement”) govern your access to and use of the Creavies website, services, and applications (collectively, the “Services”) provided by Creavies and its subsidiaries and affiliates (“Creavies,” “we,” “us,” or “our”). By accessing or using our Services, you agree to be bound by this Agreement and our Privacy Policy. If you do not agree, you must not use our Services.
This Agreement applies to all users, including visitors, registered users, and subscribers. Additional terms may apply to specific services or features, which will be disclosed at the point of use.
2. Definitions
- Item: Any digital asset available on Creavies, such as fonts, templates, graphics, music, photos, or other content.
- End Product: A customized work created using an Item, requiring skill and effort, where the Item is not the primary value.
- Tool: Fonts, add-ons, scripts, or plug-ins used to create End Products.
- Subscription: A paid plan granting access to download and use Items under the terms of this Agreement.
- Registered Use: A specific use of an Item registered with Creavies for a single End Product.
3. Your Account
To access certain features, you must create a Creavies account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your account credentials and notify us immediately of any unauthorized use at support@creavies.com.
- Be responsible for all activities under your account.
- Not share your account or transfer it without our consent.
You must be at least 16 years old to use our Services. Accounts for users under 16 will be terminated.
4. Subscription and Payment
Creavies offers subscription plans for access to Items. You agree to:
- Pay all applicable fees as described on our Plans & Pricing page.
- Provide valid payment information and authorize recurring payments for your subscription.
- Notify us of any billing issues promptly via Help Center.
Subscriptions auto-renew until canceled. You can cancel via your account settings, but no refunds are provided for partial subscription periods unless required by law.
5. License to Use Items
Subject to an active subscription, Creavies grants you a non-exclusive, non-transferable, worldwide license to use Items as follows:
- Single Use per Registration: Each Item (excluding Tools) requires registration for a specific End Product. Reusing an Item in a new End Product requires a new registration.
- Tools (Fonts, Add-ons): Tools can be used in unlimited projects during an active subscription, installed on up to two devices per subscription seat.
- End Products: You may create End Products for yourself or clients, distribute them via any medium, and make unlimited copies, provided the Item is not the primary value.
- Client Use: Clients receive a limited sublicense to use the End Product but cannot extract or reuse the Item independently.
Licenses are valid only during an active subscription. Upon cancellation, you may not use Items in new End Products, but previously registered uses remain valid.
6. Prohibited Uses
You may not:
- Use Items in End Products after your subscription ends, except for previously registered uses.
- Redistribute, sublicense, or share Items as stock, templates, or source files.
- Use Items in on-demand or made-to-order services.
- Use Items in merchandise where the Item is the primary value (e.g., direct prints on apparel).
- Allow end users to extract Items from End Products.
- Trademark Items, though you may trademark text or designs created with Items.
- Use Items in ways that are unlawful, offensive, or infringe third-party rights.
7. Music-Specific Terms
Music Items have additional restrictions:
- No use in broadcasting (TV, radio, streaming) without a separate broadcast license. Contact us at support@creavies.com.
- Film use is limited to independent projects, not theatrical releases.
- Non-P.R.O. Music: No additional performance fees, but local fees may apply.
- P.R.O. Music: Additional performance fees may apply for public use.
8. Intellectual Property
Items are owned by their creators or Creavies. You do not own Items, even if modified. You retain ownership of content you upload, granting Creavies a worldwide, non-exclusive license to host, display, and distribute it as part of the Services.
If you believe an Item infringes your intellectual property, submit a claim via our Help Center.
9. Content You Upload
You are responsible for content you upload (e.g., assets, reviews, forum posts). You agree that your content:
- Does not infringe third-party rights or violate laws.
- Is not offensive, defamatory, or harmful.
- Complies with our community guidelines.
We may remove or suspend content that violates this Agreement.
10. Termination
We may suspend or terminate your account or access to the Services if you:
- Violate this Agreement or other policies.
- Engage in fraudulent or illegal activity.
- Compromise the security or integrity of the Services.
Upon termination, you must cease using Items in new End Products and uninstall Tools. Registered uses remain valid.
11. Refunds and Cancellations
Refunds are not provided for digital downloads or subscription fees unless required by law. Contact us via Help Center for refund requests. Cancellations take effect at the end of the current billing cycle.
12. Limitation of Liability
To the maximum extent permitted by law, Creavies is not liable for:
- Indirect, incidental, or consequential damages arising from your use of the Services.
- Errors or inaccuracies in Items or third-party components.
- Loss of data, profits, or opportunities.
Our total liability is limited to the amount you paid for the Services in the preceding 12 months.
13. Indemnity
You agree to indemnify Creavies against any claims, damages, or costs arising from your use of the Services, violation of this Agreement, or infringement of third-party rights.
14. Changes to This Agreement
We may update this Agreement to reflect changes in our Services or legal requirements. We will notify you of significant changes via email or a notice on our Services. Continued use after changes indicates your acceptance.
15. Governing Law
This Agreement is governed by the laws of New South Wales, Australia, without regard to conflict of law principles. Any disputes will be resolved in the courts of New South Wales.

17. Miscellaneous
- Entire Agreement: This Agreement, along with our Privacy Policy and other referenced policies, constitutes the entire agreement between you and Creavies.
- Severability: If any provision is found invalid, the remaining provisions remain enforceable.
- No Waiver: Failure to enforce any provision does not constitute a waiver.
- Assignment: You may not assign this Agreement without our consent. We may assign it in connection with a business transfer.
